MORTGAGE AND SECURITY AGREEMENT ~
THIS htORTGAGE. made this ~?t~' day of Sept~nber 1984, between
John A. ,far~etis and Anna ?largetis, his wife hereinafter called
the "Mortgagor," and FIRST UNION SAVINGS AND LOAN ASSOCIATION,
hereinafter called the "Mortgagee;' -
W I T N E S S E T H:
That in cansideration of the premises and to secure the
performance and observance of all the covenants and conditions in
the indebtedness in the principal sum of FIFTY THOUSAND AND
NO/100 DOLLARS ($50,000.00)---------------- together with interest
thereon, as evidenced by khat certain Promissory Note of even
date herewith, executed by p;ortgagor and delivered to Martgagee,
(the "Note"); and to secure the performance and observance of all
covenants and conditions in this Mortgage and in all other
instruments securing the Note and in order to charge the
properties, interests and rights hereinafter described with such
payment and performance and to secure additional advances,
renewals, and extensions thereof and for and in consideration of
the sum of Ten and No/100 Dollars ($10.00), Mortgayor does hereby
mortgage, sell, pledge and assign to Mortgagee:

to have and to hold the same toyether with all the improvements
now or hereafter erected on such property and all fixtures now or
hereafter attached thereto together with each and every tene-
ments, hereditaments, easements, riyhts, powers, privileges, ame-
• nities and appurtenances tt~ereunto belonging or in any way apper-
taining and the reversion and reversions, remainder and remain-
ders, and also all the estate, right, title, interest, homestead,
right of dower, separate estate, property, possession and claim
whatsoever in law as well as in equity of Mortgagor of, in and to
the same in every part and parcel thereof unto Mortgagee in fee
simple.
B. Pixtures and Personal Property. Togethez with a secu-
rity interest in all personal property and fixtures affixed to or
located on the property described in paragraph A, including all
contract rights, general int3ngibles, actions and rights in
action, including all rights to insurance proceeds as all the
same may relate to any of the property described as the Mortgaged
Preperty herein, and all proceeds, prodUCts, replacements, addi-
tions, substitutions, renewals and accessions of any of the fore-
going.
