COMPANY, a Delaware corporation, lZereinafter called t~he "First Party", and
THE FLORIDA POWER & LIGHT COriPANY, a Public Utility, hereinafter called
the "Second Party", and
WHEREAS, the Second Farty, by grar,t o~ easement from Joseph }i.
Fieim and R. R. tiartin, dated July 2, 192b, and recorded January 29, 1927,
in Deed Book 74, page 300 of the ~ublic reco~-ds of St. Lucie County,
Florida, and ~uperseded by Right of Wa}~ Agreement from Maravilla GardPns
Corp., dated riay 20, 1927, and recorded in Deed Book 75, page 254, of the
public records of St. I,ucie County, Florida, did obtain an easement over,
upon and across certain property in St. Lucie County, Florida, for tl~e
uses and purposes as set out in the said easement; and
WHEREAS, tt~e First Party is the owner of the West 487.5 feet of
that part of Lots 150, 151, and I52, lying norCh of the Florida East Coast
Railway Cutoff in Maravilla Gardens Unit 4~3, Plat Book 6, page 62, St.
Lur_ie County, Fiorida, less road rights of way, as shown by that certain
Warranty Deed dated May 20, 1958 and recorded in Deed Book 238, page 254,
public records of St. Lucie County, Florida, being a subdivided portion of
the lands covered by the easements hereinabove described, and
; WHEREAS, the parties hereto do desire to set out and clarify the
said easement for the mutual benefit of both parties.
NOW, THEREFORE, in consideration of the sum o£ One Dollar ($1.00)
and other valuable considerations, the receipt of which is hereby acknowledged
as in hand paid to each party by ~he otl~er party, it is hereby covenanted,
agreed and understood as follows:
