RESOLUTSON Iv~. 66-19
SdHEREAS, the City Con~niission has here~ofore found and hereby
finds that Fort Pierce Lodge No. 1520, Benevolent & Protective Order
of El~cs, herein referred to as "E1ks", has violated its license
agreement wtth the City of Fort Pierce, dated January 9, 19~1, as
amended, in ~hat said Organization has failed to fulfill its obli-
gations thereunder including maintenance of required recreational
facil3.ties on the lands ~herein involved, resulting in the City having
to rendei° said service over an extended period of time ir~ who].e and
in part; and
~ ;~EREAS, the City Commission has heretofore requested and
~ authorized a vrritten cancellation of said license agreement, causing
such a cancellation agr~ement ~o be forwarded to sa~d organization,
t and
~
r~HEREAS, the said E1ks has failed fo agree to or ~xecut° said
ca?zcellation agreemen~. ,
_ NOW, THEREFORE, BE IT RESOLVED By the City Commission of the
- City of Fort Pierce, Florida, in regular session assembled, as
fo l lo~r~s :
~ 1. ResoZution No . 66-1, ado~ted Janua.ry 3, 1906, be and tne
same is hereby rescinded.

~ 2, The City of Fort Pierce does hereby determine that the

; instrument dated January 9, 1901, the same being recorded in Deed
Y

~ Book 253, page 367, and 0. R. Book 2, page 167, of the public
~
~ records of S~. Lucie County, Florida, between the Ci~y of For~
,

' Pierce and the Elks, be and tne same has been and is breached and
violated by said organization, and as a result thereof said agree-
~
ment, as amended, is hereby terminated, cancelled, voided and of
no further force and effect.
