H. SAtNDERS, herein called Second Party. Lti'ITNESSETH : 1VHEREAS, ttie First Party is indebted to the Second Party under that cer~ain biortgage Deed ciated February 1964, recorded in O. R. Book 80, page 331 of ~he Public Records of St. Lucie County, Florida, in the original principal sum of TWENTY THOUSAND FOUR HtTNDRED ($20,400.00) DOLLARS, which said mortgage encumbered thereby certain lots-situate in Magnolia Park, a Subdivision in St. Lucie County, Florida; and LVHEREAS, the Fir st Par ty has reque s~ed a re lease from the Second Party of all of those lots encumbered by the aforesaid mortgage deed and in liet~ thereof to subs~itute those lands as hereinafter described~ sittiate in Garden City Farms, in place of the :~iagnolia Park lots, as the sole security under said mortgage deed; and ~1iHEREAS, the ~Second Party is agreeable to the aforesaid substi- tution of security. \TOLV, THEREFORE, in consideration of the covenants herein con- tained, it is agreed by and between the parties hereto as follows: t 1. The Secc~nd Party will execute a Partial Rele ase of ; .Mortgage, releasing all of tliose lots described and set forth in the s ~ aforesaid btortgage Deed, recorded in O. R. Book 80, page 331 of ~he i ~ Public Records of St. Lucie County, Florida. ~ ( 2, The First Party does hereby substitu~e those lands de- ` ' # ~ scribed as Tracts 36, 45, 52 and 61 of GAItDEN CITY FARMS, Section 5, ~ t Township 35 South, Range 40 East, as per plat thereof on file in ~ Plat Book 2, page 5, of the Public Records of St. Lucie County, Florida, which said tracts are to be and are hereby declared ta be obligated under that certain biortgage Deed aForesaid, and that said mortgage does hereby encumber and constitute a lien upon said tracts of land, subject to all terms, conditions and covenants set forth ir~ the ~ 6~~?~~~ ~ . ~ t .
