Walter L. Marshall, of full age, being duly aworn accord-
ing to law, upon his oath deposes and says:
1. Deponent is an At~orney at Law of the State of
New Jersey, with ofFice at 44 Cooper Street, Woodbury, in ti,e
County of Gloucester, and is the at~orney for the Estate of
Katherine Huesser, D~ceased. Deponent is generally inFormed as
~ to the matters hereinafter set forth pertaining ~o Katherine
Huesser and her estate.
2. The said Katherine Huesser died on August 4, 1965
in Deptford Township, Glouc~ster County, New Jersey, l.eaving a
~ Last Will and Testament dated Apri1 18, 1963, which was duly pro-
bated at the Surrogate's of£ice o£ Gloucester County on August 23,
~965, in Book 25 oF Willa. By paragraph fourth thereof, decedent'
son, Joseph H. Huesser, was appointed Executor and Trustee and
he has duly qualified for sa~d positions.
3. Deponent further says that Katherix~e Hraesser, Widow,
conveyed certain lands and premises situate in Saint Lucie County,

Sta`ce of Florida, unto Anna M. S~nith and David Sanith, her husband,
~ by Deed dated August 8, 1964 and duly ack~~owledged on June 6,

; 1964; and on August 8, 1964 a Mortgage Deed was ~xecuted and

acknowledged by Anna M. Smith and David Smith, her husband, unto

; ~ Katherine Huesser, a widow, in the sum of $5500.00, wh3ch Mor~gage

; Deed was duly recorded on Auguat 12, 1g64, in the Clerk's Office '

of Saint Lucie County, Florida, in Book 96, Page 133. Said Deed
~ and Mortgage cover ].ands and premises described as "West 1/2 of th ~
