Comes CHARC.ES Wi+i. STONE, above the age of 21 years, and after
being first duly s~vorn by me the undersigned officer authorized to take
acknowledgments and administer oaths in the State and County aforesaid,
deposes and says:
1. The affiant is an attorney at la~v in the State of Floricla,
Couiity of St. Lucie, City of Rort Pierce, ~vith offices at 328 South 2nd
Street, Ft. Piexce, Florida and on August 8, 1964, the deponent was
the attorney for Anna M. Smith in the closing of a real estate transacti n
wherein Anna M. Smith purchased certain property from Kattterine Huesser
and that he is informed and has particular kno~vledge of the mattexs
hereinafter set out pertaining to the same.
2. That the negotiations for the purchase of the West 1/2 of
( the NE 1/4 of the SE 1/4 of Section 8, Township 35 South, Range 39 East,

; per public records of St. Lucie County, Florida, began prior to June lst
1964 and that the deed subsequently filed on or about August 8, 1964
n~as inadvertently dated August 8, 1964 for that the said date cvas the
date the deed cvas delivered to the deponent and recorded on betialf of
Anna b1. Smith a/k/a Anna M. Carlson and her husband David Smith.
3. That the abovesaid date of June 6th, 1964 is the approximate
date on ~ti~hich the deponent was advised by telephone that the deed was
then being executed and delivered by mail to Katherine Huesser's agent
in Miami who in turn subsequently on August 8, 1964 delivered the same
to the deponent as abovesaid by cvay of the office of Harvey Boothe,

an Abstractor in the City of Fort Piexce, Florida and that through

i inadvertence, the said deed had inserted thereon the date of August 8,

~ 1964 on which date a mortgage deed was executed and acknowledged by i

i Anna M. Smith and David Smith, her husband payable to Katherine Huesser,

( a widow, in the amount of $5,500.00, which mortgage was a purchase

' money moxtgage for the same said property or piece of land for which th

' abovesaid deed was executed, all being recorded in the public records
of St. Lucie County, Florida.
4. That subsequently on January 29; 1465, the deponent with his
STONE 8 STONE own Trust Account check, paid to Katherine Huesser, the sum of $200.00
