~ WITNESSETH:

~ That Grantor, for and in consideration of the sum of TEN (510.00)
DOLLARS and other good and valuable consideration paid by Grantee, the
~ receipt of which is hereby acknowledged, has granted, bargained, and sold to
~ Grantee and Grantee's heirs and assigns forever, the following described real
property situated, lying and being in St. Lucie County, Florida, to-wit:

~ Phase X I of HIGH POINT OF PORT PIERCE CONDOMINIUM
SECTION III (the "Condominium" ) according to the Declar-
ation of Condominium thereof ("Declaration") , recorded in
Official Records Book 34~ at Pages 2403 throuqh2542
of the Public Records o~` St. Lucie County, Florida as the
; Declaration may have been amended by any amendments
recorded in the Public Records of St. Lucie County,
~ Florida including, but not limited to; any amendmen~ to
~ add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof). ~
Grantee, by acceptance hereof, and by agreement with Grantor hereby
expressly assumes and agrees to be bound by and to comply with all of the
~ covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including, but not limited to, the
~ obligation to make payment of assessments for the maintenance and operation
of the Condominium which may be levied against the above-described Apart-
~ ~ ment. Grantee expressly acknowiedges the existence of a Settlement Stipula-
~ tion and Agreement for and Grant of Easements and Other Rights• (the "Settle-
~ ment Stipulation" ) and a Declaration of Protective Covenants and Restrictions
~ (the "Protective Covenants") , as well as the "Designation Notice" modifying
~ ~ the Settlement Stipulation and Protective Covenants, all as hereinafter set
fot•th. The Settlement Stipulation provides for this Condominium to be served
~ ~ by certain facilities of High Point of Fort Pierce Condominium Section 1 and
; the Protective Covenants provides for certain land use covenants upon the ~
~ ~ land areas described therein (including, but not limited to, portions of the j
~ land areas included within this Condominium) and provides for certain drainage
- P.asements and other easements and rights including , but not limited to, tt~e
~ "Roadway Easem2nt" ,"Sewage System Rights" ,"Water System Rights" and
x "Future Development Property Drainage Easement" , all as are more particuiar-
- ly described therein, all in addition to the other matters set forth in the
~ ~ Settlement StipulaUon and Protective Covenants, whiLh other matters include,
~ 1 but are not limited to, the obligation to pay certain "Assessments" as are
~ ~ respectively set forth in the Settlement Stipulation and Protective Covenants .
~ Grantee expressly acknowledges and assumes the obligation to pay the amounts
~ _ assessed against the Apartment under both the Settlement Sti~ulation and ~
~ Protective Covenants and acknowledges that "Assessments" under both the
, Settiement Stipulauon and Protective Covenants agairist all properties now or
hereafter included within this Condominium in accordance with the above-
; _ described Declaration of Condominium are "Common Expenses" of this Gondomin-
` ium as provided for in the Declaration of Condominium.
