THIS CAUSE came on to be heard upon Defendant's Motion to
Dismiss and Motion to Strike and the Plaintiff having orally amended
its Complaint to delete "national advertising assessments" from
Paragraphs 7, 3, 18, and 19 and it appearing that attorneys fees are
provided for by the contract between the parties, upon consideration,
it is
ORDERED that Defendant's riotions to Dismiss and Strike are
hereby denied and Defendant shall respond to Plaintiff's Cemplaint

E within twenty (20) days of the date of this Order.
