MODIFICATION OF MORTGAGB AGREBMBNT
This \~lodification of Mortgage Agreement dated and entered into the day
of s"'= - 1984 by and between FOCUS REAL ES'CATE FINANCE CO., a Delaware
corporation "Focus") and THE SANDS OCEAN VIEW DEVELOPMENT, a Florida general
partnership (the "Sands").
NiITNESSF.TH:
WHEREAS, FOCUS REAL ESTATE FINANCE CO., a Delaware corporation
{"Focus") is the owner and holder of that certain mortgage executed by THE SANDS
OCEAN VIEW DEVELOPMENT dated May 31, 1984, and recorded in Official Records
Book 433, Pages 1689, of the Public Records of St. Lucie County, Florida; and
WHEREAS, in consideration of loans and extensions of credit from Lehman bc
Wasserman to the Sands and to more fully secure the payrnent of said loans and exten-
sions of credit, the parties agree as follows:
1. The lien of the Focus is extended to encumber the following described
real praperty. ,
The Condominium Parcel known as Unit ?06, of THE SANDS
ON THE OCEAN, A CONDOMINIUiVi SECTION I(the "Condo-
minium") according to the Declaration of Condominium there-
of, recorded in Official Records Book 404, at Pages 1995
through 2081, of the Public Reeords of St. Lucie County,
Florida, together with an undivided share in the common ele-
ments (as defined in the Declaration) appurtenant thereto.
2. The Sands shall bear all costs and expenses associated with the en-
cumbrance of the above described prcperty.
3. Exeept as modified herein, all terms, covenants and conditions of the
Mortgage modified hereby shall remain in full force and effect and are ratified, con-
firmed and approved in all respects.
IN WITNFSS WHEREOF, the parties hereto have executed these presents as of the
day and year first above written.
