HomeMy WebLinkAbout0969 1 ~ ~_v b~2333 IVIODIFICA`I'?ON OF MORTGAGE AGREEMENT This Modification of Mortgage Agreement dated and entered into the day of~;,v~~,~~, 19~4 by and between t3ANKERS TRUST CO~IPANY, a New York banking corporation "Bankers Trust") and THE SANDS OCEAN VIEW DEVEL•OPMENT, a Florida general partnership (the "Sands"). WITNESSETH: WHEREAS, Bankers Trust is the owner and holder of that certain rnortgage executed by LUCILLE V. COSTA, joined by her husband, GEORGE A. COSTA, dated iV1ay 13, 1974 and recorded in Official Records Book 227 at Page 1694 of the Public Records St. Lucie County, Florida, as modified and extended by Vfodification and Extension of Mortgage and Collateral Mortgage dated June 8, 1977, and recorded June 19, 1977 in Official Records Book 27t, at Page 626 of the Public Records of St. Lucie County, Florida, and as further modified and extended by Modification and Extension of Mortgage and Collateral 19ortgage dated November 5, 1980 executed by the Sands-0cean View Development, a Florida partnership and The Sands Lake View Development, a Florida partnership and recorded in Official Records Book 342, at Page 1731 through 1797 inclusive of the Public Records of St. Lucie County, Florida; and WHEREAS, in consideration of loans and extensions of credit from Bankers Trust to the Sands and to more fully secure the payment of said ?oans and extensions of credit, I the parties agree as follows: 1. The lien of the Bankers Trust '.Vlortgage is extendQd to encumber the following described real property. The Condominium Parcel known as Unit 706, of THE SANDS ON THE OCEAN, A CONDOMINIUM SECTION I(the "Condo- minium") according to the Declaration of Condominium there- of, recorded :n Official Records Book 404, at Pages 1995 through 2081, of the Public Records of St. Lucie County, Florida, together with an undivided share in the common elements (as defined in the Declaration) appurtenant thereto. 2. The Sands shall bear all costs and expenses associated with the en- cum5rance of the above described property. - ~ t 3.
