CONDOMINIUM SPECIAL WARRANTY DEED

THIS INDENTURE, mad~ this 21st day of December, 1984, between ~
Luke R. Pascale & Elizabeth R. Pascale, his wife (hereinafter
referred to as "Grantor") and Jack Weichman, Trustee of the Luke '
R. Pascale Irrevocable Trust dated 12/21/84~ or any successor
Trustee named therein, whose Post Office Address is 9050 Columbia '
tivenue, iiunster, Inciiana 4632i (hereinafter reterred to as "Grantee"):
WITNESSETH
That the Grantor, for and in consideration of the sum of Ten
Dollars ($10.00)and other good and valuable consideration, to him in
hand paid by the Grantee, the receipt of which is hereby acknowledged,
has granted, bargained and sold to the Grantee, and the Grantee's
successor, the following described real property, situated, lying
and being on Hutchinson Island~ Jensen Beach, St. Lucie County,
Florida, to-wit:
UNIT 1106, OCEANA SOUTH CONDGMINIUM I, according to the Declara-
tion of Condominium, recorded in Official Records Book 356, page
227, et seq., and as amended by Amendment recorded in Official
Records Book 397, page 2969, and any further amendments thereto,
all of the Public Records of St. Lucie County, Florida,
TOGETHER WITH an undivided share in the Common Elements appur-
tenant to such Unit and all other appurtenances to such Unit as set
forth in the Declaration of Condominium and any amendments thereto.
Grantee, by acceptance hereof, and by agreement with Grantor,
hereby expressly assume~ ~nd agree~ te ~e ~e»n~ by and to comply
with all of the covenants, terms, conditions and provisions set forth
and contained in (A) the Declaration of Condominium and Amendments
thereto, including, but not limited to, the obligation to make payment
of assessments for Common Expenses (as said term is defined in the
Florida Condominium Act, Chapter 718 of the Florida Statutes) which
may be levied against the above described unit; and (B) the Oceana
South Declaration of Covenants, Restrictions and Easements, dated
May 13, 1981, recorded in Official Records Book 356, page 292, et
seq., Public Reccrds of St. Lucie County, Florida, its supplements
and amendments thereto (the "Oceana South Declaration of Covenants"),
6 including, but not limited to, the obligation to make payments of
E "Assessments", as said term is defined in the Oceana South Declaration
of Covenants. ~
This conveyance is made subject to the following:
1. Real estate taxes for 1984 and subsequent years.
2. Applicable zoning and other governmental regulations, restric-
tions and ordinances.
. 3. All the terms, provisions, conditions, rights, privileges,
obligations, easements and liens set forth and contained in the Dec-
r laration of Condominium, its supplements and amendments tehreto,
~ and all instruments therein referred to;
~ 4. All of the terms, provisions, conditions, rights, pri~~ileges,
~ obligations easements and liens set forth and contained in the t~ceana -
~ South Declaration of Covenants, and all supplements and amendments
~ tnereto; anci all instruments therein referred to;
# 5. Al1 agreements, covenants, conditions, restrictions, rights
; reservations and easements of record, if any, which may now affect
