AFFIDAVIT
STATE OF FLORIDA
COUNTY OF ST. LUCIE
COMES NOW, John T. Brennan, as the City Attorney for the
City of Fort Pierce, who being under cath does say:
1. That attached to this Affidavit and incorporated by
herein, is an Agreement entered into by and between the City of
Fort Pierce, Florida and John E. Corbally, James ri. Furman and
David M. Murdoch, as Trustees under the provisions of a Trust
Agreement dated December 28, 1983, and known as the MacArthur
Liquidating Trust Agreement, by and through their authorized
agent, The Bankers Land Company, a Florida corporation. Said
Agreement also includes the legal description of the property
within St. Lucie County to which said agreement applies.
2. That it was the intent of said Agreement to limit
development of said property in accordance with said Agreement
and for said limitations to apply to the successors in title
to said property.
AND FURTHER AFFIANT SAYETH PIOT.
