K N 0 W AL L M E N B Y T H ESE P R ESE NTS that Triad Develop~ent Corporation, Inc. of the
County of St. Lucie and State of Florida in consideration of the sum of One Dollar ($1.00) and
other valuable considerations, receipt of which is hereby acknowledged, does hereby grant to the
Flo~ida Power b light Company, a Corporatin~ organized and existing under the laws of the
State of Florida, whose address is P. 0. Box 029100 (9250 W est Flagler Street), M iam i, Florida
33102, and ta its Sutcessors and Assigns (the term "assigns" meaning any person, firm or
corporation owning by way of assignment all rights under this Agreement or a portion of such '
rights with the Grantee or its other assigns retaining and exercisi~g the ather rights), an
Easement forever for a Rightrof-Way, 10 feet in width, to be used for the construction,
operation and maintenance of one or more overhead and underground electric transmission and
distribution lines, including, but not li m ited to, wires, poles, cables, conduits, ancho~s, guys and
equipment associated therewith, attachments and appurtenant equipment for com munication
purposes (all of the foregoing hereafter referred to as "facititie~'), over, under, in, on, upon and
across the lands of the Grantor situated in the County of St. Lucie and State of Fiorida and being
more particularly described as follows:

together with the right and privilege from ti m e to ti me to reconstruct, inspect, alter, i m prove,
enlarge, add to, change the voltage, as well as the nature or physical characteristics of, replace,
remove or ~elocate such facilities or any part of them upon, across, over or under the above-
described R ight-of-W ay with atl rights and privileges necessary or convenient for the futl
enjoyment or the use thereof for the herein described purposes, including, but not limited to, the
right to cut and keep clear all trees and undergrowth and other obstructions within said Right-of-
Way and on lands of Grantor adjoining said Right-of-Way that may int~rfere with the proper
construction, operation and maintenance of such facilities or any part of them, the right to mark
the location of any underground facilities by above ground and other suitable markers and the
right of Ingress and Egress for personnel and equipment of Grantee, its contractors, agents,
successors or assigns for the purpose of exercising and enjoying the rights granted by this
E ase m ent and any or all of the rights granted hereunder. ~
The Grantor, however, reserves the right and privilege to use the above-described Right-
of-W ay for agricultural and such other purposes except as herein granted or as m ight interfere or
' be inconsistent with the use, occupation, maintenance or enjoyment thereof by Grantee or its
successors or assigns, or as m ight cause a hazardous condition; provided, however, and by the
; execution and delivery hereof Grantor so expressly agrees that no building, well, structure,
~ obstruction or i m provem ent (including any i m pravem ents for recreational activities) shall be
~ located, constructed, maintained or operated ~ver, under, upon or across said Right-of-Way by ~
~ the Grantor, or the heirs, personal representatives, successors or assigns of Grantor. ~

# By the execution hereof, Grantor covenants that they have the right to convey zhis ~
~ Easement and that the Grantee and its successors and assigns shall have quiet and peaceful
! possession, use and enjoyment of this Easement and the rights granted hereby. ~
