WARRANTY DEED
THIS WARRANTY DEED made the ~2nd day of A.D.,
1985 by FOREST A. CAPOBIANCO and LOUISE J. CAPOB ANCO, his wife,
hereinafter called the grantor, to FOREST J. CAPOBIANCO and
CAROLINE G. CAPOBIANCO, his wife, for their lives, the remainder
to the heirs of the body of FOREST J. CAPOBIANCO, whose post-
office address is 2282 West Midway Road, Fort Pierce, Florida 33482,
hereinafter called the grantee:
WITNESSETH: That the grantor, for and in consideration of
the sum of $10.00 and other valuable considerations, receipt
whereof is hereby acknowledged, hereby grants, bargains, sells, ~
aliens, remises, releases, conveys and confirms unto the grantee, ~5
all that certain land situate in St. Lucie County, Florida, viz:
The West 1/2 of the following-described property: ,

Lot 61, less the West 5 acres thereof, of WHITE CITY SUB-
DIVISION, as per plat thereof on file in Plat Book 1, Page
23 of the public records of St. Lucie County, Florida, which
property is also described as the S 1/2 of the SW 1/4 of the
NW 1/4 of Section 4, Township 36 South, Range 40 East, less
the West 5 acres thereof, containing 12 acres, more or less,
and lying and being in St. Lucie County, Florida.

~ EXCEPTING THEREFROM all rights-of-way for public roads,

It is the intention of this deed to convey to FOREST J.
CAPOBIANCO and CAROLINE G. CAPOBIANCO, his wife, or to the
survivor of them an estate for life, with remainder, per stirpes,
to the lineal descendants of FOREST J. CAPOBIANCO, including
those that are not also lineal descendants of CAROLINE G.
CAPOBIANCO, such lineal descendants in being subject to open and
to take in, per stirpes, other lineal descendants of FOREST J.
' CAPOBIANCO who come into being during the continuance of the life
estate, all pursuant to Florida Statute~§ 689.17.
TOGETHER with all the tenements, hereditaments and appurte-
nances thereto belongir_g or in anywise appertaining. I

G. CAPOBIANCO, his wife, a life estate in them and into the
~ survivor of them, the remainder in fee simple forever to the

~ representatives, and assigns.

~ AND, the grantor hereby covenants with said gran~ee that the
f grantor is lawfully seized of said land in fee simple; that the
~ grantor has good right and lawful authority to sell and convey
said land; that the grantor hereby fully warrants the title to
; said land and will defend the same against the lawful claims of
' all persons whomsoever; and that said land is free of all encum-
~ brances, except taxes accruing subsequent to December 31, 1984.
