CHARLES WILLIAM STONE, by his undersigned attorney, hereby
dismisses his third party claim against TROPICANA PRODUCTS, INC. for
the reason that the Plaintiff, JAMES D. HURLBERT, recovered his workers
compensation benefits, which were affirmed by the First District Court
of Appeal, and since this was a claim for cantribution on the part of
the employer, TROPICANA PRODUCTS, INC., who is now paying workers
compensation benefits to the Plaintiff, JAMES D. HURLBERT, there is no
claim existing between CHARLES WILLIAM STONE and the Plaintiff's
employer, TROPICANA PRODUCTS, INC., for the reason that tne Plaintiff
is receiving his workers compensation benefits in accordance with the
law. Therefore, and for that reason, CHARLES WILLIAM STONE hereby
drops, dismisses, and gives notice to the world that he has no claim or
third party claim in this matter due to the fact that the Plaintiff,
JAMES D. HURLBERT, has no malpractice claim against the Defendant for
the reason that the Plaintiff, JAMES D. HURLBERT, did in fact receive
his workers compensation benefits. ,
Notice is further given that the undersigned attorney caill not be
in the State of Florida on Friday, August 23, 1985, and will therefore
not appear at the hearing scheduled on that date as he will be in
California.
