(b) During the consttuction stage of development, the
developer shall not allow the cleaning of equipment or material
within the dripline of any tree or qroups of.trees to be
protected. Neither shall the developer allow the disposal of
waste materials such as paint, oil solvents, asphalt, concrete,
mortar and so on within the drip~ine of any trees or qroups of
trees.
(c) No attachments or wire other than those of a protective
nature shall be attached to any tree.
(d) During the land clearinq and construction stage of
development a representative of the ARC shall petiodically
inspect the site to insure compliance with the provisions of this
chapter.
(e) Tree location and replacement actively permitted or
required under this restziction shall be done in accordance with
standard horticultural practices and procedures and all such
plantings shall be reasonably maintained and attend to promote
successful establishment thexeof.
X. EXCEPTIONS bUE TO EMERGENCIES
During the period o£ an emergency such as a hurricane,
tropical storm, f lood or any other Act of God, the requirements
of these restrictions may be waived by the ARC.
XI. EXCEPTIONS E'OR BETTERMENT PGANS
Applicants for perrnission shall be entitled to demonstrate
by means o£ a proper landscape plan that an improvement for
bettetment of the environment can be accomplished over the
existing site conditions, if such landscape plan is carried out
to its £ullest. If such a detailed landscape plan is ~o offered
and is accepted by the ARC, the applicant shall quarantee the '
faithful adherence and completion of such landscape plan.
XII. EXCEPTIONS AS TO CERTAIN TREES
The following trees or types of trees shall be exempt from
the terms aaa requirements of these restrictions:
(a) Any diseased, infected or infested tree.
(b) Schinus terebinthffolivs (Brazilian Pepper Tree).
(c? Metopium toxiferum (Poison Wood).
(d) M~laleuca leucandendron (Melaleuca or Punk Tree).
(e) Casuatina spp. (Australian Pine Tree).
