'7 _ ~ ~ . . - ; THE RESERVE PLANTATION SUBDIVISION DECLARATION O~' COVENANTS AND RE5TRICTIONS T DECLARATION, made this 2~6 aay of , 19 , by CALLAWAY LAND & CATTLE CO., INC a Flor da corporation, which declares that the real property hereinafter described, hereinafter referred to as "THE RESERVE PGANTATION SUBDIVISION" (RPS) is and shall be held, transferred, sold, = conveyed and occupied subject to the covenants, restrictions, easements, charqes a~d liens (sometimes hereinafter referred to as "Covenants and Restrictions") hereinafter set forth. I. PROPERTY SUBJECT TO THIS DECLARATION: ADDZTIONS THERETO, _ DELETIONS THEREFROM Section 1. Legal Description: The real property which }s and shall be held, transferted, sold, conveyed and occupied subject to this Delcaration is lcoated in St. Lucie County, Florida, and comprises all the parcels, platted or unplatted - within or upon the property legally described on Schedule "A" hereto. , Section 2. Additional Propertv: Such additional property, ~ lots, units or parcels as developer, its successors or assigns, ~ may from time to time desiqnate as being subject to this i Delcaration by the placing of record in an instrument ex~cuted ; with formalities of a deed, makinq such desiqnation, ft being I specifically understood that said desiqnation may, in developer's t sole discretion, apply to all or any part of this Declaration, ~ and in addition, that this Declaration may apply in full, in ~ part, as modified, or as amended to any additional property, ~ lots, units, or parcels designated by the Developer as being ~ subject hereto. € ~ II. DEFINITIONS Section 1. Developer: As the term is hereinafter used, ~ shall mean Callaway Land & Cattle Co. Inc. a Florida ~ corporation, and its successors and asgigns. ~ ~ ~ ~ Section 2. Association: As hereinafter referred to, shall ¢ mean, The Reserve Plantation Association, Inc., a Florida ~ corporation, not for profit to be formed by Developer within ~ ~ three (3) years from the date af c2osing the first sale by ~ Developer or when thirty percent (30$) of the lots are sold ~ whf.chever shall firg~ occur. After recordation of ar~icles of incorporation for the Association by Developer in. the public ~ ~ records of St. Lucie County, Florida, every owner of a lot in Reserve Creek, must become a member of Association and become subject to such rules and regulations as the Association's Board ~ of Directors may adopt; in any event the Developer shall have the ~ riqht to nominate or select all of the eoard of Directors of the Association when the Association is formed however at such time 7-16-85 Res Plt . ao~K 473 PAGE 919 ~ - ~ _ _ -
