' as the Developer has sold ninety-nine (99) percent of the lots ~ within the subdivision the Board of Directors shall be elected by the membership of the Association from amonq the owners of lots in The Reserve Plantation; provided however, that so long as Developer is the owner of any lot in The Reserve Plantation, DeveZoper sha21 be entitled to representation on the Board of Directors of Association. Section 3. Committee or Architectural Gammittee (ARC): As hereinafter referred to. shall mean a committee consisting of a minimum of three persons who shall be designated and appointed by Developer; should a vacancy o_cCUr in the committee~ fihe Developer, its successors o~ assiqns. sha21 have the sole right to appoint a replacement member of the committee; from and after formation of Association and recordation of articles of incorporation in the public recotds, all functions of committee provided herein shall vest in Association at such time as the Developer telinquishes control. ~ III. PROPERTY RIGHTS ~ Section 1. Title to Common Area: The only common area in ~ the property herein shall be the streets, roads and the easements. Developer may retain the legal title to the stteets, roads and easements so long as it owns at least one Lot in The Reserve Plantation. On or before conveyancQ by Developer of the last Lot which it owns in The Reserve Flantation, Developer shall convey the streets, roads and easements to the The Reserve Plantation Association, Inc., subject only to any restrictions, conditions, limitations, reservations, and easemQnts of record. Section 2. Owner's Easements of Enjoyment: Evexy Owner shall have ~ right and easement of enjoyment i'n and to the common j area which shall be appurtenant to and shall pass with the title ~ to-every Lot, subject to the followinq: f t A.
