cost of collection, as provided for the other assessments of the
Assocfation, and shall be subordinate to mortqage Liens to the #
extent provided by Section 9 of Article V hereinabove. ~
Section 3. Access at Reasonable Hours: For the purpose of j
performing the maintenance authorized by this Article, the Asso- ;
ciation, through its duly authorized agents or em ployees, shall ~
have the right, after reasonable notice to the Owner, to enter ~
upon any Lot or the exterior of any impravements thereon at
reasonable hours on any day except Saturday and Sunday.
VIII. ARCHITECTURAL CONTROL
Section 1. Necessity of Architectural Review and Approval:
No im provement or structute of any kind, including without limi-
tation, any buildinq, fence, wa11, swimming pool, tennnis court,
screen enclosure, sewer, drain, disposal system, decorative
building, landscape device or orject, or other improvements shall
be commenced, erected, placed or maintained upon any Lat, nor
shall any addition, change or alteration therein or theteof be
made, unless and until the plans, specifications and location of
the same shall have been submitted to, and approved in writing
by, the ARC. All plans and specifications shall be evaluated as
to harmony of external desiqn and location in relation to
surrounding structures and topography and as to conformance with
the Architectural Planninq Critezia of the Association, a copy of
which is attached hereto as Exhibits "A,B & C", as the same may
be ac~ended from time to time.
Section 2. Architectural Review Committee (ARC): The
architectual and control functions of the Association shall be
administered and performed by the Architectura2 Review Committee
(the ARC), which shall consist of Three (3) or more members, who
_ need not be members of the Association. The Developer shall have
the right to appoint all of the members of the ARC or such lesser
number as it may choose, as long as it owns at least one Lot in
` The Reserve P2antation. Members of the ARC as to whom Developer
may relinquish the right to appoint, and all members of the ARC
after Developer no lonqer owns at least one Gat in The Reserve
Plantation shall be appointed by and shall serve at the pl~asnre
of the Board of Directors of the Association, A majorfty of the
ARC shall constitute a quorum to transact business at any meeting
of the ARC, and the action of a majority present at a meetinq at
which a quorum is present shal2 constitute the action of the ARC.
Any vacancy occurrinq on the ARC because of death, resignation or
other termination of service of any member thereof, shall be
f i l led by the Board of Directors; except that Developer, ~o the
exclusion of the Board, shall fill any vacancy created by the
death, resignation, removal or other termination of services of
any member of the ARC appointed by the.Developer.
Section 3. Powers ~ Duties of the ARC: The ARC shall have
the following powers and duties:
