DEGLARATION OF' COVENANTS AND RESTRICTIONS
DECGARATION, made this~day of ~J .
19 ~~J, by CALLAWAY LAND ~ CATTLE CO., INC., a Flor~da
corporation, which declares that the real property hereinafter
described, hereinafter referred to as "RESERVE GREER
SUBDIVISION"(RCS) is and shall be held, transferred, sold,
conveyed and occupied subject to the cov~nants, restrictions,
easements, charqes and liens (sometimes hereinafter referred to
as "Covenants and Restrictions") hereinafter set forth.
I. PROPERTY SUBJECT TO THIS DECGARATION: ADDITIONS THERETO,
DELETIONS THEREFROM
Section 1. Leqal Description: The real property which is
and shall be held, transferred, sold, conveyed and occupied
subject to this Delcaration is lcoated in St. Lucie County,
Florida, and comprises all the parcels, platted or unplatted
within or upon the property legally describec3 on Schedule "A"
hereto .
Section 2. Additional Property: Such additional property,
lots, units or parcels as developer, its successors or assigns,
; may from time to time desiqnate as beinq su~ject to this
~ Delcaration by the placinq of record in an instrument executed
~ with formalities of a deed, makinq such desiqnation, it beinq ~
~ specifically understood that said designation may, in developer's
sole discretion, apply to all or any part of this Declaration, ~
and in addition, tha't this Declatation may apply in full, in
part, as modified, or as amended to any additional property, ~
lots, units, or parcels designated by the Developer as beinq
subject hereto. '
II. DEFINITIONS
Section 1. Developer: As the term is hereinafter used,
shall mean Callaway Land & Cattle Co. Inc., a Florida
corporatfon, and its successors and assigns.
Section 2. Association: As hereinafter referr~d to, shall
~ mean, Reserve Creek Association, Inc., a Florida corporation, not
for profit to be formed by Developer within three (3) years from
tne date of closing the first sale by Developer or when thirty
percent (308) of the lots are sold whichever shall first occur.
After recordation of articles of incorporation for the
Aasociation by Developer in the public records of St. Gucie
County, Florida, every owner of a lot in Reserve Creek, must
become a member of Association and become subject to such rules
a~d requlations as the Association's Board of Directors may
adopt; in any event the Developer shall have the right to
nominate or select all of the Board of Directors of the.
Association when the Association is formed however at such time
