as the Developer has sold ninety-nine (99) percent of the lots
within the subdivision the Board of Directors shall be elected by
the membershfp of the Association from amonq the owners of lots
in Reserve Creek; provided however, that so lonq as Developer is
the owner of any lot in Reserve Creek, Developer shall be
entitled to representation on the eoard of Directors of
Association.
Section 3. Committee or Architectural Committee (ARC): As
hereinafter referred to, shall mean a committee consisting of a
minimum of three persons who shall be designated and appointed by
DeveZoper; should a vacancy occur in the committee, the
Developer, its successors or assigns, shall have the sole riqht
to appoint a replacement member of the committee; from and after
formation of Association and recordation of articles of
incorporation in the public records, ail functions of committee
provided herein shall vest in Association at such time as the
Developer zelinquishes control.
III. PROPERTY RIGHTS
Section 1. Title to Common Area: The only common azea in
the praperty herein shall be the streets, roads and the easements
for access to the clubhouse. Developer may retain the leqaZ
title to the streets, roads and easemen~s so lonq as it owns at
least one Lot in Reserve Creek. On or before conveyance by
Developer of the last Lot which ft owns in Reserve Creek,
Developer shall convey the streets, roads and easements to the
Reserve Creek Association, Inc., subject only to any
restrictions, conditions, limitations, t~servations, and
easements of record.
Section 2. Owner's Easements of Enjoyment: Every Owner ~
shall have a right and easement of enjoyment in and to the common
area which shall be appurtenant to and shall pass with the title
to every Lot, subject to the following:
- A. Rules and regulations governinq use and enjoyment of the
common areas adopted by the Association; and subject to the
unlimited and unrestricted use of said streets and roads by the
Developer and his successors and/or assigns;
B. Restrictions contained on any and all plats of aZl or
any part of the streets, roads and easement for access to the
clubhouse filed separate2y with respect to all or any part or
parts of the Property;
C. It is contem plated that adjacent lands will be developed
and subject to these restrictions. Nothinq contained herein
shall limit or restrict the Oeveloper's use of the streets and
roadways on this property, and further, the Developer
speci£ically reserves unto fts successors and/or assigns the same
absolute unrestricted use of said streets and roads.
