To recommend, from time to time, to the Board of Directors of the Association n~odifications and/or amendments to the Architectural Planninq Criteria. Any modification or amendment to the Architectural Planninq Criteria shall be consis- tent with the pravi~ions of this Declaration, and shall noi~ be effective until adopted by a majority of the members of the Hoard of Directors of the Association at a meeting duly called and n~oticed and at which a quorum is present and votinq. 5ection 4. Purpose 4f the ARC: The ARC shall provide for a systematic and uniform review of all proposed improvements and construction of any type or nature whatsoever within the subdivi- sion. The ARC shall review all plans for said improvements, it beinq the intent of the Developer to provide for sound and esthetically pleasing development of the subdivision. The ARC shall assure itself of the soundness of the proposed improvements in order to prevent, to the extent possible, rapid and eatly deterioration. In addition, the ARC shall evaluate the proposed improvements with em phasis upon their harmonious incorporation into the community as a whole ans3 with specific emphasis on external design, location of the improvement in relation to surrounding structures and/or improvem ents, topography and confozmity to the Resttictive Covenants im posed hereunder. Section 5. Procedure before the ARC: Prior to th~ commen- cement of any wvrk on the premises contem plated for improvement I an application must be submitted to the ARC, together with such E fully executed application f~rm and any fee as may then be re- ~ quired by this Declaration, two complete sets of plans and speci- fications for any improvement or structure of any kind are also ` required. All plans of residences and other structures are to be drawn and stamped by a registered Florida architect. All building contractors must be quality home builders, licensed to build in St. Lucie County. No later than thirty (30) days after receipt of said plans, the ARC shall respond to the application in writing approving or disapproving said application. In the event the ARC fails to respond within said thirty (30) day period, the plans shall be deemed approved. In the event of disapproval of the plans as submitted, no ~rork or construction shall commence in furtherance of the proposed improvements. In the event of approval of said plans, the applicant shall provide the ARC with written notice of the completion of the staking of ~ the property. No further work shall be performed upon the property until the ARC has inspected the premises and approved said stakeout. In the event the ARC fails to respond within ~ forty-eight (48) hours, after receipt of said r~otice, (excluding Saturdays, SUndays and legal holidays), said work shall be deemed approved, and this requirement shall be deemed waived by the ARC. See attached, Site Plan and Architectural Review Requirements, (Exhibit 'B'). VIIII. RESTRICTIONS Section 1.
