oi the Property, have the right to coll_rt and retain such rents as they become due and payable. Upon acceleration under the other provisions
hrreot or the ubandonment of the F:operly, Ihe Murtgagee shall be entitled to take possession of and manage the Property and to collect the
rents of the Property including those past due. All rents rolle~ied shall be applied first to the payn?ent of the costs of management of the
Proprrty and collertion of the rents including but not limiied ~u attorney's and real estate brolcer's fees and then to the sum ucured by this
hlortgage. Thc Mortgagee shalf be liable to account only for ihose rents actually received.
13. ln the event suit is instituted Io Forerlose this mortgage the Mortgagee shali be rntitled at any~ time pending such foreclosure to apply
to the court having jurisdiction thereof far the ap~wintment of a receiver of the propeny and all of ~he rents, incoma, prolits, issues and
revenues thereof from whateve~ source derived and the court shall forthwith appoint su~h receiver with the usual dutia and powers of
recei~~ers in like cases and said appointment shall be made as a matter of strict right to the Mortgagee and without reference to the adequacy
uf the v:~lue of the Property or the solvency of the Mortgagor or any other party to such suit. The Mortgagor hereby waives th~ right to objecc
to the appointment of a rtceiver and consents that such appointment shall bt made as an admitted equity and as a matttr af absolute right to
the Mortgagce. _
14. The abstract(s) of title covering th~ Property shall at all times during the term of this mortgage remain in possession o( the Mortgagee
and in the event of foreclosure or other transfer of title to the Property, all right title and interat of the Mortgagor in and to the abstract(s)
shall pass to the purchaser or grantee.
15. If any installment of principal and interest is ~lot paid to the Mongagef within fifteen (IS) days aiter the same becomes due and
payable or if each and every of the Mortgagor's promises and covenants set forth in this mortgage and/or the Note are not fully and promptly
~rformed, complied with and abided by, the entire sum of principal and interest se~ured by this mortgage shall at the option of the
Mortgagee become due and payable in full at once as if originally stipulated to be paid at such time notwithstanding anything in this mortgage
or Note to the contrary.
16. !f the ownership of the Property or any part thereof becomes vested in a person other than the Mortgagor. the Mortgagee may,
without notice to the Mortgagor, deaf with such successor(s) in interest with reference to this mortgage and the Note in the same manner as
Hith the Mortgagor, without in any way discharging the Mortgagor's liabifity hereunder or upon any debt hereby secured. No sale of the
Property and no larbearance on the part of the Mortgagee or extension for the payment of the debt hereby secured shali operate to release,
discharge, modify, changt or affect the original liability of the Alortgagor either in whole or in part.
17. The terms "Mortgagor" and "Mortgagee" wherever used in this instrument shalt include the heirs, personal representatives, ;
and assigns uf the respective parties; the singular number shall include the plural, the plural shall include the singulaz and the use of any `
gender shall include all genders. ~
