County, New Hampshire on October 3, 19~5 and a domiciliary personal representative was appointed; authenticated copies thereof and of so much of the domiciliary proceedings as required by Section ' 734.102 of the Florida Probate Code, along with Petition for • ~ Ancill.ary Administration were filed by your petitioner~and Letters 1 of Ancillary Administration were issued to Roger G. Orr on October II, 9, 1985 in the above entitled estate. I i 2. Decedent's will did not contain a power of sale and f~r ' reasons set out below petitioner deems it foX the best interest of the estate th~t rhe foll~wing described property of the estate be sold under the terms of a Contract for Sale and Purchase entered ~ into by decedent before her death, to-wit: i ~ The Condominiuni Parcel known as Apartment 1032-E of PHASE VII of HIGH POINT OF FORT PIERCE COi:~OMINIUM ! SECTION III (the "Condominium"), according to the ~ ~leclaration of Condomium thereof ("Declaration"), recorde~i in Official Records Book 341 at Pages 2403 through 2542 of the public recorsis of St. Lucie Cutmty, Florida as the Declaration may have been amended by any amendments recorded in the public records of St. Lucie County, Florida includir.g, but not limited to, any amendment to add the aforesaid Phase to the ~ Condominium (if such Phase be other than Phase I ~ *hereof) . 3. That on August 26, 1985, Freda Mitchell enter~d into ~ a Contract for Sale and Purchas~ ~ith Frank T. Jones and Margaret ~ . N:. Jones, his wife, for the sale and purchase of the above des- czibe~ property for the sales price of $58,000 cash. That Hoyt C. Murphy Real Estate is holdi~ng the deposit monies of $2,000. That ' the contract called for a closing date of September 30, 19~35 with occupancy by the purchasers no later than October 5, 1985.
