(b) Each party r~presents and warrants to the other
that the party does not own any property of any kind other than
the property referred to in this Stipulation and Property Settle-
ment Agreement. The parties further warrant that each has made a
full disclosure to the other of his or her current f inancial condi-
tion, and each has disclosed ~he extent and value of their respective

property. If it later appears that either party now owns any other ~
praperty or has a present interest in any other property, it shall

be divided equally between the parties hereto. ~
(c) Each party understands and agrees that this t

Stipulation and Property Settlement Agreement constitutes the entire r
contract of the parties and supersedes any prior understandings or
agreements made by them on subjects covered by this Stipulation ~
and Property Settlement Agreement. There are no representations ~
or warranties other than those set fo~'th in this Stipulation and ~
Property Settlement Agreement. f

15. DEFAULT: The parties ag~cee that any provisions
; under the terms of this agreement that is not complied with by

. either party may be enfarced by the other party in any manner
permitted by law, including enforcement by contempt proceedings.
In the event that either party defaults in any obligation hereunder, ~
the party in default shall be Ziable to the other for all reasonable i
~
t
expenses, including attorney's fees incurred in the enforcement of S
the obligations created by this agreement.

16. FAILURE TO ENFORCE: The failure of either party ;
to insist upon strict performance of any of the provisions of this
agreement shall not be construed as a waiver of the right thereafter

to insist upon performance of that or any other provision of this

agreement. t
17. RESTRAINING ORDER: The parties agree that, upon !

the re uest of either =
q party hereto, if necessary, a mutual restrain-
ing order shall be entered by the appropriate court against each
