a) To elect to take against any wili or codicil of the other
party now or hereafter in force;
b) To share the other pa~ty's estate; -
c) To act as executor or administrator of the other party's
estate.
S. The parties each hereby transfer to the other their separate
property and all personal and intangible property now in their respective
possession except as otherwise provided for in this Agreement.
6. Husband and Wife have heretofore previously dtvided all persona!
property owned by the parties.
7. Husband is currently emnioyed by Florida Power and Light Company,
and through his employment and payroil deduction has made certain investments
and stock purchases in what is known as ESOP and Thrift Plan. Wife shall
have an undivided one-haif interest in the acco~nts and stocks so purchased
and Husband shail execute the documents necessary to convey said one-half
interest 4o Wife within thirty days of the~date hereof. It is understood,
however, that according to the rules governing these stock purchase plans,
Husband may not coliect the fut! cash value accruing under said plans for a ~
certain time withou# penalty. Wife shall not compell Husband to sell or other-
wise obtain the cash value accruing under said plans untii his rights under
the rules governing each plan have fuily vested and he can obtain same
without penalty. Upon Husband's obtaining the case value under said
accounts, he shatl forthwith pay one-half of same to the Wife.
8. Husband shall pay and remain solely responsible for alf debts ~
~ incurred by the parties prior to the date of the partie's separation, August 13,

9. The parties are the parents of DOROTHYGARNER, born on
' November 16, 1975. The parties shall share parentai responsibility for said

~ child, with the Wife maintainin~ the child's primary physical residence.
10. Prior to the Wife's marriage to Husband, a child was born to her,
FERN ANN WEST, born February 20, 1973, paternity of said chiid never
having been determined and said child being born out of wedlock and
illegitimate. For the purposes of this Agreement, said child shall be treated
as a child of this marriage, notwithstanding that no legal adoption has taken
place wherein Husband has adopted said chiid. It is therefore agreed beiween
