WBERSAS, there were two (2) children born at issue of the marriage between the aforementioned eusband and Wife, to wits JA!!IB BUDDIB and JBSSICA BUDDIE, born April 13, 1978 and November 12, 1974, respectivelys it is further the purpose of this separation and property settlement agreement to provide for the future custody, control, and support of said minor children. 6. NOW TH6REFORE, in consideration of the premises and the mutual promises and undertakings herein contained, and for other good and valuable considerations, the parties agree: 7. SBPARATION: The parties may and shall, at all times hereafter, live separate and apart; free from tne interference, authority and control, direct or indirect, by the other, as fully an8 to the same extent as if he or she were sole and unmarried. ~ 8. DISSOLOTION PROCEEDINGS: In the event a petition for dissolution of marriage is completed at any time her~after by either party in any Court of competent jurisdiction, then in such event, this Separation and Property Settlement Agreement shall be incorporated in any decree or judgment which may be entered in such action. 9. NON WAIVER PROVISION: Failure of either party E I E to insist in any one or more instances upon the strict i performance of any one or more of the terms and provisions of this Separation and Property Settlement Agreement, shall not be construed as a waiver or a relinquishment in the future of any such term or provision, and the same shall continue in full force and effect. No waiver or relinquishment shall be ~ ~ deemed to have been made by either party unless in writing, ~ signed by that party. ; ~ ; ~ 10.
