SUMM~RY FINAL JUDGMENT
This cause came before the Court on Plaintiff's Motion
for Summary Judgment, and the Court having considered the Motion
and having reviewed the pleadings, exhibits and~affidavits filed
herein, and having taken into consideration'aII admitted facts,
it is therefore,
ADJUDGED as follows:
1. The Plaintiff, FIRST AMERICAN BANK AND TRUST, has
established by competent proof, the allegations oft3~e Complaint and
ha~ proc3uced the original mortgage note in the amount of One Million
Three Hundred Fifty Thousand Dollars ($1,350,000) and the original
mortgage securing payment thereof, copies of which were attached to
the Complaint. .
2. Plaintiff is entitled to foreclosure of its mortqage lien
~
and said Iien is superior to any cZaim or estate of the named Defen- ;
dants herein on the following-described real property located in St.
Lucie County, Florida:
The legal description of said property is attached hereto
as Exhibit "A".
3. Plaintiff, FIRST AMERICAN BANK AND TRUST, is due from
~ the Defendant, WILLIAM E. WILLIAMS, trustee on the promissory note
dated October 7, 1982, $1,350,000.00 as principal, $462,781.46 as
interest at the rate of 16$ per annumfrom October 7, 1982, until the
entry of this judgment, ~J 8n D~ for reasonable attorney's fees,
and $~~6 .S~D court costs now taxed under the promissory notes,
