This cause came before this Honorable Court for hearing
upon Defendant's Motion to Strike Reply, Mation for Leave to Add
Additional Affirmative Defense, and Motion for Summary Judgment;
the Court having heard arguments of counsel and having considered
the matters, it is ~
ORDERED and ADJUDGED that Defendant's Motion to Strike
Reply and Motion for Leave to Amend to Add Additional Affirmative
Defense are granted after review by this Honorable Court and after f

counsel for Plaintiff's failure to appear at the hearing on these 1-

matters; however, this Honorable Court did defer ruling upon Defen-

- dant's Motion for Summary Judgment until such time as counsel for F

Plaintiff did appear, to which counsel for Defendant had no objec- i
tion, and it is further,
- ORDERED and ADJUDGED that Defendant's Motion for Summary

Judgment regarding Plaintiff's claim for malicious prosecution is
granted. Plaintiff may apply to this Court for rehearing within j
~aenty (20) days of the date of this Order, providing case law in ~
support oE his position. Defendant shall have Fifteen (15) days ~
thereafter within which to respond to Plaintiff's proferred law,
and it i_s further,
ORDERED and ADJUDGED that Defendant's Motion for ~ummary
Judgment regarding Plaintiff's claims for lost profits and earning
capacity is granted. The PZaintiff may apply for rehearing within
