THE PRETRIAL CONFERENCE having been held on October 16,
1985, it is
ORDERED AND ADJUDGED .
1. The parties Stipulate and agree the accident occurred on or
about March 9, 1981, at the K-MART Store located at 2111 Soutt; Federal
Highway, in Fort Pierce, Florida. The store •aas owned and controlled
by K-MART CORPORATION. The Defendant has alleged comparative negligence
as an affirmative defense to the personal injury claim.
2. The parties abandon none of the issues in this case, the
issues as reflected in the Pretrial Statement of each party.
3. The parties state at the present time there are no unusual
points of law.
4. As to the witness and/or exhibit lists of each party, either~
party may amend their respective lists up to 5 days before trial.
Each party reserves all evidentuary objections except as to authenticity. ~
5. Discovery in this matter shall remain open until the day of
trial. ~
6. Each party shall have three (3) peremptory challenges. ,
