Flagier Street~, M lam i, F iorida 33 iu~, and to iLs Successors, an Aerial Easement forever over a parcel of land 10 feet in width, to be used for the i construction, operation and maintenance of one or more overhead electric trans~nission and ~ distribution lines, including, but not limited to, wires, cables, and equipment assoctated ~ therewith, attachments and appurtenant equipment for com munication purposes, together with the right to install One (1) pole in the East 10 feet of the South 10 feet of Lot 34, Block 85, £ described below, (all the foregoing hereafter referred to as "facilitie~'), over the lands of the ~ G~antor situated in the County of St. Lucie and State of Florida and being more particularly described as follows: ~ ~ ~ Pareel 125 A parcel of land 10.00 feet in width lying in Section 11, Township 37 South, Range 40 East, St. Lucie County, Florida, more particularly described as: The south 10.00 feet of L 0 T 34, B L 0 C K 85 according to the P L A T of P T. ST. L U C I E, U N IT ~ 5 as recorded in PLAT BOOK 14, PAGE 12 of the Public Records of St. Lucie County, Florida. Containing U.018 acres more or less. ~ . ~ together with the right and privilege from time to time to reconstruct, inspect, alter, improve, enlarge, add to, change the voltage, as well as the nature or physical characteristics of, replace, remove or relocate such facilities or any part of them over the above described parcel of land, with all rights and privileges necessary or convenient for the full en,j~yment or the uses thereof for the herein described purposes, including but not limited to, the right to cut, remove and keep said easement clear of all trees, undergrowth, structures and other obstruction which may create a hazardous condition or that may interfere with the proper constructio~, operation and ~ maintenance of such facilities or any part of them and the right of ingress and Egress over and upon the East 10 feet of the South 10 feet of the above described lot for personnei and equipment of Grantee, its contractors, agents or successors, for the purpose of exercising and enJoying the rights granted by this Easement and any or all of the rights granted hereunder. Provided, however, that no poles, guys or anchors shall ever be placed in, on or under the easement lands except in the East 10 feet of the South 10 feet of the above described lot. It j being understood that the easement hereby granted is an aerial easement except for the East 10 ; feet of the South 10 feet of the above described lot. ~ ; By the execution hereof, Grantor covenants that he has the right to tonvey this Easement i and that the Grantee and its successors and assigns shall have quiet and peaceful possession, use c and en~oy m ent of this E ase m ent and the rights hereby granted.
