ARTICLE III. ~ y
I give, devise and bequeath all the rest, residue and
re~ainder of ~ny estate, real, personal and mixed, ~f whatsocver
kind and nature and wheresoever situated, of which I shaZl die
seiz~d or poss~ssed or to which I shall in any way be en~~t2eci,
including Iapsed legaGies and devises, but exc.luding any
property over or concerning which I may have any power of
appointment, to my wife, ETHEL C. SCHOQS, if sh~ survives me,
otherwise to my siblings and my said wife's siblings who sha11
survive me, in equal shares, share and s;iare alike. ~
. ARTICLE IV.
In the event I die in a common disaster with any beneficiary
under this Will, or should such beneficiary's death and mine
occur simultaneously or approximately so, or under circumstances
which would make it difficult to ascertain which of us surv~ved
the other, or whether such beneficiary survived some deadline ar
event so as to take hereunder, I direct that each such beneficiary
shall be presumed and deemed not to have survived me.
ARTICLE V. ;
All estate, inheritance, transfer, legacy, succession and
other death taxes and duties of any nature whi~h may be assessed
or imposed upon or with respect to property passing under this
Will or property not passing under this Will shall be paid out of
my .state as an e~.pense of administration and no part of said
~axes shall be apportione~ or prorated to ~ny legatee or devisee
u:~der this k'ill or any person owning or receiving any property not
passing under this Will.
