FIFTH: Sach party hereby irrevocably waives and releases
' the other party from any and all claims that he or she may noW
~ have. or may hereafter acquire for alimony, support or
} ' maintenanace, other than as hereinbefore provide~. Each party

- ; waives, releases and relinquishes all rights that he or she may
now have or may hereafter acquire as the other party's spouse
' under the present or future laws of any jurisdiction, and
,
~ further waives, (a) to elect to take against any Will or Codicil
~ ` of the other party now in force; (b) to share in the other
~
party's estate and to exerc;ise any right of dower or courtesy
he or she may now have or hereafter acquire in the other party's
estate; and, (c) to act as administrator or personal ~
~ representative of the other party's estate except only as
provided by Will or a Cadicil executed after the date of this
~ Agreement.
SIXTH: Each of the parties represents that he or she has
~ no contracted and will not hereafter contract any debt, charge
~ or liability in the name or upon the credit of the other
~
or for which the other or the estate of the other might or
f; could become liable, and agrees, in any event, to indemnify and
~ hold the other and the estate of the other harmless therefrom in
~
~ all respects.

~ SEVENTH: In the event tha~ any Final Judgment by a Court of
~
~
~ competent jurisdiction shall be entered dissolving the marriage

~ of the parties hereto, said parties hereby stipulate that this

~ Agreement may be introduced into evidence, and upon approval of
~ the Court, the same shall be incorporated in the Final Judgment

~ therein entered.

EIGHTH: Modification or waiver of any of the provisions of

this Agreement shall be effective only if made in writing and
executed with the same formality of this Agreement. Failure of
either party to insist upon strict performance of any of the
provisions of this Agreement shall not be construed as a waiver
or any subsequent default of the same or similiar nature.
NINTH: This Agreement shall be construed and governed in
~RRa°fROSS accordance with the laws of the State of Florida.
