LUCIE COUNTY LAND DEVELOPMENT ~ CODE - ST. LUCIE RIVER SHORELINE SETBACKS TO ALLOW FOR 8 CONSTRUCTION OF A PAVILION ON THE RIVER PARK MARINA 9 PROPERTY, LOCATED AT 500 EAST PRIMA VISTA BOULEVARD. 10 it WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the 12 testimony and evidence, including, but not limited to the staff report, has made the following 13 determinations: 14 15 1. The St. Lucie County Parks and Recreation Department has applied for a variance 16 from the provisions of Section 6.02.02(B)(2)(a), of the St. Lucie County Land 1 ~ Development Code - St. Lucie River Shoreline Setbacks, to allow for the construction 18 of a pavilion on the River Park Marina property, located at 500 East Prima Vista 19 Boulevard, as depicted on the attached map in Exhibit °A" and described below. 20 21 2. On August 17, 2010, this Board held a public hearing on the petition, after publishing 22 a notice of such hearing and notifying by mail all owners of property within 500 feet 23 of the subject property. 24 25 3. After consideration of the testimony presented during the August 17, 2010 public 26 hearing, including staff comments and the standards of review for granting variances 27 set forth in Section 10.01.30, St. Lucie County Land Development Code, the Board 28 of County Commissioners has made the following determination: 29 30 The requested variance meets the standards of review as set forth in 31 Section 10.01.30 of the St. Lucie County Land Development Code and 32 is not in conflict with the general purpose, goals, objectives and 33 standards of the St. Lucie County Land Development Code, the St. 39 Lucie County Comprehensive Plan, and the Code of Ordinances of St. 35 Lucie County. 36 37 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. 38 Lucie County, Florida: JOSEPH E. Pursuant to Section 10.01.30 of the St. Lucie County Land Development Code, the 3 request of the St. Lucie County Parks and Recreation Department for a variance from 4 the provisions of Section 6.02.02(B)(2)(a), of the St. Lucie County Land Development 5 Code - St. Lucie River Shoreline Setbacks, to allow for the construction of a pavilion 6 at River Park Marina, 500 East Prima Vista Boulevard, is hereby approved for the 7 property depicted on the attached maps as Exhibit "A" and described as follows: 8 9 A parcel of land lying southerly of Prima Vista Boulevard in Section 21, 22, and 27, l0 Township 36 South, Range 40 East, St. Lucie County, Florida being more particularly 11 described as follows: 12 13 For a point of reference commence at the centerline intersection of Naranja Avenue 14 and Prima Vista Boulevard as shown on the Plat of River Park Unit 4, as recorded in 15 Plat Book 11, Page 9, Public Records of St. Lucie County, Florida, thence North 53° 36' 16 00" East along said centerline of Prima Vista Boulevard, 364.50 feet; thence departing 17 said centerline south 36° 26' 00" East, 50.00 feet to the intersection with the southerly 18 right-of-way line of Prima Vista Boulevard and the mean high water line of the North 19 Fork of the St. Lucie River and the Point of Beginning of the following described parcel 20 of land; thence southeasterly, easterly, and northwesterly along said mean high water 21 line to the intersection with the southerly right-of-way line of Prima Vista Boulevard; 22 thence South 53° 34' 00" West, along said southerly right-of-way line 585.66 feet to the 2 3 Point of Beginning. 24 25 Said Parcel containing 12.74 acres, more or less. 26 2 7 Parcel I D#: 3422-331-0000-0002 and 3427-221-0001-0006 28 29 Location: Approximately one (1) mile west of US Highway One, on the south side 30 of Prima Vista Boulevard. 31 32 C. This resolution shall be recorded in the Public Records of St. Lucie County. 33 39 D. The effective date of this resolution shall be the date of adoption contained herein.
