LOUDEN, hereinafter referred to as "Settlor", and DOYLE P. LOUDEN, herein- after referred to as "Trustee", and FIRST NATIONAL BANK AND TRUST COMPANY OF STUART, a National Banking Association possessing trust powers and having its office in the City of Stuart, County of Martin, and State of Florida, as "Standby Corporate Trustee". The Settlor hereby transfers to the Trustee the property 2isted in the attached schedule. That property and aZl investments and reinvestments there- of and additions thereto are herein collectively referred to as the "Trust Estate", and shall be held upon the following trusts: FIRST: During the lifetime of the Settlor, the Trustee shall pay the in- come from the Trust Estate in convenient installments to the S~ettlor, or otherwise, as he may from time to time dixect in writing, and also such sums from the principal as he may request. If at any time or times the Settlor is unable to manage his affairs, the Trustee may usa such sums from the income and princ~pal of the Trust Estate as the Trustee deems necessary or advisable for the care, support and comfort of the Settlor, and any pezson dependent upon the Settlor, or for any purpose the Trustee considers to be for the Settlor's best interests, adding to principal any income not used. For purp~ses of this Agreement, the Settlor shall be considered to he unable to manage his affairs if he is under a legal disability, or by reason of illness or mental or physical disability, is unable to give prompt and intellig,ent consideration to his financial matters, and the determina[ion as to the Settlor's inability at any time shaZl be made by BETTY M. LOUDI~:*~ and JENNIFER M. LOUDEI3, or the survivor of them, and a competent physician who is noC the family doctor or close acquaintance of the said BET'TY M. LOUDEh at:d/or JENNIFER M. LOUDEN, and the Trustee may rely upon written notice of that determination.
