HomeMy WebLinkAbout0990 The Standby Co-Trustees shall [ake control of Trust administration upon the death or incompetency of the Settlor (as fiereinabove stated), or upon designation by the Settlor. The Standby Co-Trustees, upon taking control of the Trust admini- stration, shall: (a) have sole custody of all investments and cash from time to time comprising the Trust fund; (b) keep all records and books of accounts pertaining to the Trust; and (c) perform all ministerial duties necessary or appropriate to the administration of the Trust. Upon the death of tt~e Settlor, or any any time thereafter, BETTX M. LOUDEN and JENNIFER M. LOUDEh, on unanimous vote, may discharge themselves as the Standby Co-Trustees and appoint a Corporate Trustee; said Corporate Trustee being bound by the terms of this Trust instrument. At any such time as BETTY M. LOUDEN and JENNIFER M. LOUDEN are acting as Standby Co-Trustees, they each must act jointly and consult each other in regard to all trust matters. If, at any time, BETTY M. LOUDEN or JE,~INIFER M. LOUDEN, are unable to agree as to Trust administration, thev shall submit any disputed matters to a disinterested third party for arbitra- tion, or unani~ously appoint a Corporate Trustee. I further direct that in considering who a suitable arbitrator would be ~ i ~ ~ in any tr~sst dispute that both of my Co-Trustees, BETTY M. LOUDEN and ~ JENNIFER M. LOUDEN, give due consideration in consulting with my attorney, THOMAS A. FOGT, or my Certified Public Accountant, ROBERT L.
