If any payment of principal interest called for:her`eunder is not paid within ten (10) days of its due date,
Borrower agrees to pay a late charge equa! ~ either'five percent (5%) of any such instaliment or Fve Dollars
(~5.00), whichever is greater. . _
In no e~ent shall the amount of interest due o~ paymeats in the nature of interest payable hereunder or under
any mortgage security agreement securing this No~t; exceed the maximum rate of interest allowed to be
contracted fa~ by applicabte taw, as changed from time to time, and in the event any s~ch payment is paid by the
undersigned or received by Hotder. then, such excess sum shat! be c~edited as a payment of principal, unless
the unders+gned shall notify Holder, in wriiing, that the undersigned elects to have such excess sum retumed to
it forthwith
Time is of the essence of this Note and, in case this Note is co(lected by iaw or through an attorney at taw, or
under advice therefrom, the undersigned agr~e to pay all costs of collection, inctuding reasonable attomey's
fees, which fees are deemed to inciude. but not limited to, aN fees incurred in al! matters of collection, and
enforcement, construction and interpretation, b~fore. during and afte? suit, trial, proceedings and appeals,
bankruptcy proceed~ngs or creditors' reorganization or similar proceedings.

All persons or corporations now or at any time tiable, whether primarily or secondarily, for the payment of the
~ indebtedness hereby evidenced, for themselves, their heirs, legal representatives, successors and assigns,
~ respectivety hereby expressly waive any presentment, demand for payment, notice of dishonor, protest, notice
of nonpayment or protest, diliger.ce in cotlection, and do consent that the time for all payr~ents or any part
thereof may be extended, rearranged, renewed orpostponed, and further eonsent that the collat~ral security or
any part thereof may be released, exchanged, added tp or su~istituted for vi?ithout in anywise modifying,
altering, ~eleasing, effecting or iimiting their respeCtive liability hereunder or the lien of any security instrument.
If more than one party shall execute this Note, the term "undersigned", as used herein, s3~af I mean atl parties
signing this Note and each of them, who shall be jointly and severatfy obligated hereunder. This Note is secured
by a Mortgage of even date herewith upon reai property in the State of Florida
