1, The Lessee shall record a oonservation easement fnr a minimum of 11,786.71 ~
feet of shoreline in perpetuity to run with the land, prohibiting any
additional docking tacilities or any other such development along the
lessee's shoreline. The lessee shall provide d~oc.wnentation of said
recording to the lessor within thirty days of Hoard action prior to execu-
tion of this lease. _
2, The lessee agrees to ensuore that the ternns and vanditions of the recorded
conservation easgt~ent prohibiting any additional ctiocking facilities or any
other develoQcnent ala~g the subject shore2ine are met.
3. The total sqt.~are foo~tage and representativ+e anriual lease fee shall be
phased in over the first three years of the lease. Phase 1(49,737.75
square feet) would be effective up~n Board approval on Noven~ber 5, 1985;
Phase 2 t42,159.75 square feet) w~uld be ac3deci to tatal 91,897.5 square
feet rn Novenber 5, 1986; and, Phase 3(25,959.6 square feet) w~uld be
added to total 117,867.1 sguare feet (the total lease area requested) rn
November 5, 1987. No oonstruction will be allowed in Phases 2 and 3~til
the respective effective dates.
4. The lessee understan~ and agrees that the c~onsideration may be autateti-
cally adjusted by the Board to include a rne-time pr~ni.um hased upon F
enhancer~t of the value of the adjacent upland property upon a3optian of 3
a rule requiring such payment. _ =
S. Any and all construction activities associated with Phase 3 dockinq faci-
lities approved by the Grantor rn t3~vgnber 5, 1985 are expressly prohi- -
bited except upon a subseque~t finding by the Grantor, upan review of the
study data and the F&wS analy~is, that the ac~ditional slip~page proposed
under Phase 3, wh~ viewed together with other marina projects then in
existenoe and proposec~ at ttie time, will not generate c.wnulative effects
that will adversely affect the m3natee. ,

6. Tne lessee agrees to provic3e copies of all data accutmilated under the !
study required in the Atmy Corps of r~gineers peanit for pha~ses one and
two to the Departsn~t of Natural Rescurces, Division of Resource
Management as said data becon~es available.
