ORDER
THIS CAUSE came on before the Court on Motion by Defendant
to Dismiss Plaintiff's Fourth Amended Complaint. Having reviewed the
record in this cause, h$ard the arguments of counsel, and being other-
wise duly advised in the.premises, it is hereby
~ ORDERED AND ADJUDGED that the Motion is denied in part and
~ granted in part. The Motion to Dismiss is granted as to Count VII of ~
~ I
the Fourth Amended Complaint and with respect to those matters '
~
- previausly ajudicated in this Court's order dated May 27, 1986. As
to all other matters, the Motion is denied. Plaintiff shall have
twenty days from the ciate of this Order within which to f ile its
~ Fifth Amended Complaint.
