WHER'~AS, Plaintiff, State of Florida Departm~~~~ of
Environmental Regulation (DER), has filed a Complaint in the
above-styled matter, and
WHEREAS, DER and Defendant, Hutchinson Island Limited,
Inc. (HILI), hav~ each consented to the making and entry of this ~
Consent Final Judgment without further pleading ar trial or
ad;udication af or findings on any issues of fact or law raised by

~ 1. This Court has jurisdiction of the subject matter of
and th~ parties to this ac¢ion.
~ 2. The provisions of this Consent Final Judgment shall
~ be binding on the parties and their agents, successcrs and

assigns.

~ 3. DER has alleged that HILI fai~ed to comply wi~h the
F permit issued for its former sewage tre~tment facility and
~ operated without a permit, in violation of Section 403.161(1)tb),
~
~ Florida Statutes. HILI admits that some violations occurred but
~ alleges that it was at all times making a goo3 faith effort to
~
~
~ conn~ct its faci.Iity to the regional sewage treatment plant.
