Any installment payment rnade prior to any due date or dates, or any prepayment, may cause decreases in some of the amounts designated above for the reason tha! the unpaid outstanding pnncipat balance w~11 be reciuced and the interest rate designated above is applied to such ~educed ~tstanding balance to determine the amount of interest that ~s due. • I( Bank deems itselt insecure, or upon the happening of any ot the followmg events, each ot which shall const~tute a default hereunder, all I~abilities a! each Maker to Bank shall thereupon or thereafter, at the Option of Bank, withOUt notice or demand, become due and payable: (a) tailure ot any Obligor (which term shalt mean and include each Maker, endorser, surety and guarantor of this note} to perform any prov+s~on ot any secv~+ty agreement or mortgage securing the repayment hereof, to pay intersst hereon when due, or to pay any other 6abii~ry whatsoever to Bank when due; (bj the death ot any Obligor, (c) the fi6ng of any petit~on under the Bankre?ptcy Code, or any sim~tar federal or state statute by or against any Obligor; (d) an application tor the appointment ot a receiver or the makong ot a general assignment for the benetit of cred+tors by, or the insolvency of, any Obligor; (e) the entry of a judgment against any Ot~ligor; (f) the issuing of any wrii of attachment or writ of garnishment, ar the filing of any lien, against any property of any Obfigor: (g) the taking of possess~on of any substantial part of the property of any Obligor at the instance ot any governmental authonty; (h) the dissolution, merger, consohdat~on or reorgani2ation ot any Obligor, or (i) the assignment by any Maker of any equity ~n the real property which is secur~ty (ar this note, except as is permitted under the terms of the cnortgage, without the pnor wriiten consent of Bank. In addition te the mortgag~ secur+ng this laan, Maker hereby grants to Bank a security interest in att prc~perty oi Maker now or at any time hereafter in the possession of Bank in any capaciry whatsoever, including but not timited to, any balance or ~share of any depOSit, trust, or agent aCCau~t, as secunty fOr the payment of this note, and a similar lien upon and security interesE in a11 such property ot sach Maker as secunty for the payment oi all other liabilities ot each Maker to Bank (including all liabilities of each Maker). The Obligors, jointly and severatly, promise and agree to pay all costs and expenses of col{ection and reasonable attorneys' fees, whether incurred in connection with co!{ection, trial, appeal or otherw+se. Presentment, demand, protest, notice of dishonor, and extension oi time without notice are hereby waived by each and every Obl~gor. Maker acknowledges receipt of a compteted copy of this note and mortgage on the above date. NOTICE TO COSIGNER: You are being asked to guarantee this ~ebt. Think carefully before you do. If the borrower doesn't pay the debt, you wil! have to. Be sure you can aftord to pay if you have to and that you want to acaept this responsibility.
