2l. The loan represented by this Mongage and the Note is personal to the Mortgagar anJ the Marigagee made
the loan to the Mortgagor based upon thc credit of the Morigagor and the Mohgagec's judgement of the abitity of thc
Mortgagor to repay all sums due under Ihis Mortgage, and therefore this Mongage may not be assurned by any subse-
quent hotder of an interest in the Mortgaged Properiy. If all or uny part of the Mortgaged Property, or any intcrest there-
in, is sald. conveyed, transferred (including a transfer by agreemcnt for decd or land contract) or funher encumbered by

24, hlangagor rcpresents and warrants that if a corporation, it is duly organit.ed and validly existing, in goc~d
standing under the laws of the state of its incorporation. has stock outstanding which has been duly and validly issued,
and is qualified to da business and is in good standing in the State of Florida, with full power and authority to cansum-
mate the loan comtemplated hereby; and, if a parine~ship, it is duly fortned and validly existing, and is fully qualified to
do business in the State of Florida; wi~h full power and authority to consummate the foan comtemplated hereby.
25. In the event any one ar more of the pn~visions contained in this Mortgage or in the Note shall for any rca-
son be hetd to be invalid, illegal or unenforceable in any respect,-such invalidity, iNegality or unenforceability shali, a~
the option of the Mortgagee. nol affect any other provisions oF this Mortgage. but this Mortgage shail be constn?ed as if
such invalid, illegal or unenforceable provision had never been contained herein ar therein. The totai interest payabte
pursuant to the Note or this Mortgage shall not in any one yearexceed the highest lawful rate of interest permiited in the
State of Florida. '
26. The covenants and 'agreements herein contained shall bind and the benefits and advantages shal! inure to
the respective heirs, executors, administrators, successors, and assigns of the parties hereto.ldherever used, the singu-
lar number shall include the pturat, the plural the singalar. and the use oi any gender shall be applicabte to all genders. All
covenants, agreements and undertakings shaU be joint and several. ln the event additional numbered covenants or paragraphs
are for convenience inser~ed in this hlortgage, such additionaf covenants shall be read and given effect as though following this
covenant in consecutive order.
