HomeMy WebLinkAbout0966 ; . ~ ~ , t ~ ~ . ~ ' . . ~ . . ~ ~ . . . ~ ~ . . • . ~ ~ - HowAVer at such time as the Developer has sold eighty six (86$) percent o~ the lots within the subdivision, the Board of Directors shall be elected by the membership of the As~ociati.on from.amonq the owners of lots in Bay St. Lucie Subdivision; Provided however, tha~ so long as Developer is the owner of any lot in Bay St. Lucie Subclivision, Developez shall be entitled to one directorship on-the Board of Directors of the Association. Section 3. Committee c~r Architectural Review Committee (ARC): As hereinafter referred to, shall mean a committee consist~ng of a minimum of three persons who shall be d~signated anc3 appointecl by - Developer; should a vacancy occur in the committee, the Developer, ~ its successors or assigns, shall have the sole right tio appoint a ~ replacement member of the committee; from and after formation of the ~ Association and recordation of Articles of Incorporation in the public ~ records, all functions'of the Committee provided herein shall vest in ~ the Association at such time as the Developer relinquishes control. ~ III. PROPERTY RIGHTS - Section l. Title to Common Area: The only common area in the proper~y herein shall be Riverbend Lane,---Riverbencl Road, Riverbend Trace, ~he drainage easements, the easement access roads to the property, Tract "E" access tract to part of the waterfront, Tract "C°', and Tract "A" a~joining Riverbend Road. Developer may retain the legal title to the streets, raads and easemer,ts so long as it owns at least one Lot in Bay St. Lucie Subdivisian.~~ On or before conveyance by Developer ot the last Lot which it`~-awns in Bay St. Lucie Subdivision, Developer shall convey the streets, roads ar~d easements to the waterfronts to the Bay St. Lucie Property Owners Association, Inc., subject only te any restrictitons, conditions, limitations, xeservations, and easements of record. Section 2. Owner's Easements of Enjoyment: ~very Owner shall have a right and easement of en~oyment n and to the common area which shall be appurtenant to and shall pass with the title to every Lot, subject to the following: A. Rules and regulations governing use and enjoyment of the common areas adopted by the Association; and 5ubject to the unlimited - ancl unrestricted use of said streets and raads by the Developer and his successors and/or assigns, whi.ch rules and regulations shall not hinder nor restrict the unfettered access, ingress and egress of the ~wner's, members and thPir gues~s access to their lots. B. Restrictions con~ained on the Plat of Bay St. Lucie Subdivision. . ' C.. It is contemplated that adjacent lands may be developed and ` subject to these restrictians.
