Section 3. Access at Reasonable Hours: For the purpose of.
perForming the maintenance author~.zed by this Article, ~he
Association, through its duly authori~ed agents or employees, shall
have the right, after reasonable notice to the Owner, to enter upon
any Lot or ~he exterior of any improvements thereon at reasonable
hours on any day except Saturdays and Sundays. .
VIII. ARCHITECTURAL REVIEWt
Section l. Necessity of Architectural Review and Approval: No
improvement or structure of any kind, including without limitation,
any building, fence, wall, swimming pool, tennis court, screen
enclosure, sewer, drain, disposal system, c~ecorative building,
landscape device or objec~, or other improvements shall be commenced,
erected, placed ar maintainea upon any Lot, nor shall any addition,
chanqe or alteration therein or thereof be made, unless and until the
plans, specifications and location of the same shall have been
submittec~ to, and approved in writing by, the Architictural Review
Committee (ARC). All plans and specifications shall be evaluated as
to harmany of external design and locarion in relati.on to surrounding
structures and tapography and as to conformance with the Architectural
Planning Criteria of the Association, a copy of which is attached
hereto as Exhibit "A" ~ Arct~itectural Plannan~ Criteria, Exhibit "B" -
Site Plan & Architectural Revie~ Requirements, ~Exhibit "C" -
Land_scape Plan Rec~uf rements, and Exhl'-bi-t "n" Landscape Requirements
Gover~ning Exis~ing Tr~es and Vegetation and Waterfront Bank
Stabilization Plantings, as the same may be amended from time to
time.
Section 2. Architectural Review Commit~ee (ARG): The
architec~ural and control funetions of the Association shall be
administered and performed by the Architectural Review Committee (The
ARC), which shal_1 aonsist of Three (3j membErs, who neec3 not be
members of the Association. The Developer shall have the right to
appoint all of the members of the ARC or such lesser number as itc may
choose, as long as it owns at least one Lo~ in Bay St. Lucie
Subdivision. Members of the ARC as to whom Developer may relinquish
the right to appoint, and all members of.the ARC after Developer no
~ lonqer owns at least one Lot in Bay St. Lucie Subdivision shall be
~ appointed by and shall serve at the pleasure of the Boarci of Directors
of the Association. A majority of the ARC shall constitute a quorc~m
to transact business at any meeting of the ARC, and the action of a
majority present at a meeting at which a quorum is present shall
coristitute the action of the ARC. Ar.y vacancy occurring on the ARC
' because of death, resignation or other termination of service of any
member thereof, shall be filled by the Board of Directors; except
ttiat Developer, ~o ~he exclusion of the Boaxd, may fill any vacancy
created by the death, resigna~ion, removal or other termination of
services of any member of the ARG appoxnted by the Developer.
