At the time initial cons~ruction is ~roposed on any Lot the lanc7scaping plans must ~e su m tte or written approval, prior to _ commencement of construction. For any new construction ~he Architec~ural Review Committee or the Association shall requir~ a minimum verified expenditure for landscaping of Three Thousand Fiv~ Hundred ($3500.410) Dollars, exclusive of clearing costs, sod, fill, and irrigation costs during initial construction. Landscaping according to the apgrovec3 -plan must be completec3 within sixty (60) days of substantial completion of the home. See the attached Landscape Plan ftequirements (Exhibits "C & D"). Section 11. 4dors ancl Smoke: Objectionable odors or smoke shall not.be created or a~lowed on or about any Lot, Street, Road or Common Area in Bay St.Lucie Subdivision either by a property owner, guest resider.t or visitor. Outdoor barbeque cooking shall be exempt from ! this provision. E. ! Sectian 12. Noise: Objectionable noises, as determined by the ~ _Board, shall not be created or allowed in Bay St.Lucie Subdivision. All motorized vehicles, mowers, saws and powered c3evices shall be ~ equiped with appropriate mufflers or sound control~. Electric ~ amplifiers shall not be operated or directed so as to cause a nuisance to neighboring properties. ~ Section 13. Nuisances: Nothing shall be done or maintained on any Lot which may be or become an annoy~nce ar nuisance to the neighborhood including noises, liqhting and visual abberations. In the event of a aispute or question as to what may be or become a nuisance, such dispute or question shall be submitted to the Board of Directors, which shall rendex a decision in writing, which deci5ion shall be dispositive of such dispute or s~uestion. Section 14. Signs: No sign or sign board of any kind, illuminated or non-illum n ted, shall be d~splayed to the public view on~any Lot except for the following: ~ A. The owner of, or exclusive sales agent for said owner of, a . single-family residence or any Lot(s) may place one professional type non-illuminatecl sign advertisinq th~ property for sale. Said sign shall not to exceed a total of two hundred sixteen square inches or 12 inches by 18 inches in dimensions. Any~such sfgn shall be black letters on a white background. B. Placement of said sign shall be wi~hin 5GJ feet of the street frontage of the Got or in the alternative on the waterfron~ side but not waterward of the established waterfront SetBack line.(See Exhibit "A", Paragraph 5).
