Section 20. Maintenance: Each lot shall be maintaic~ed according
to standards set by ~he Rssociation from tiime to time provided,
however, ~ha~ nothing herein contained shall prohibit landscape
improvement5 to a parcel or parcels as provided in Section 8 hereof.
Section 21, Utility Easements. The developer, its successors or
assigns shall hereby have an exclusive ~asem~n~ to place pipes, wires
or conduits over Any Lot in Bay St.Lucie Subdivision within ten (10)
feet of the streetfron~ property line and shall have the perpetual
right to enter on any Lot for the purpose of inspecting, maintaining
or repairing said installations. All utility lines ~erving individual
Lots in Bay St.Lucie Subdivision, incl.iading electrical, ~elephone and
; cable TV lines, shall be placed underground as approved by the ARC.

~ Section 22. Lot Cleanliness: No refuse or trash pile, garba e

pit, or unsightly ob~ects, including occasionally used or inoperable
vehic~es shall be allowed to be placed or suffered to remain anywhere ~
on any Lot, and in the event that any Owner shall fail or refuse to
keep his Got free of the above or any garbage pits or refuse piles or
other unsightly grow~hs or objects, then the Association may enter
upon said Lot and remove the same at the expense of the Owner, and
such entry shall not be deemed a trespass. All gaxbage or trash
containers must be placed in a walled-in area so that they shall not
be visible trom adjoining Lots, the waterfront, streets or public
areas. -
X, GENERAL PROVISIONS '
Section 1. Duration and Remec3ies for Violation: The Covenants
and Restrictions o this lleclaration shall run with and bind the
Property, and shall inure ~o the benefit of and be enforceable by the
Developer, the Association or the Owner of any Property subject to
this Declaration, th~ix respective legal rrepr~sentatives, he~irs,
succ~ssors ancl assigns, fo~c a term of fifty (50) years from the date
of this Declaration is recorded, aftex which ~ime said Covenant~ and
Restrictions shall automatically be extendea for successive periods of
~ ten (10) years unless an ins~rument 5igned by the then Owners of
two~thirds (2/3) of the Gots has been_recorded, amending or rescinding
same in whole or in part. Violation or breach of any condition, -
covenant or restriction hexein containec3 shall give the Developer
and/or Association and/or Owner{s) in addition to all other remedies,
the right to proceed at law or in equity to compell com~aliance with
the terms of said cor~ditions, covenants and restrictions, and to
. prevent the viola~ion or breach of~ any of them, and ~he expense~of
such litigation shall be borne by the ~hen Owner or Owners o~ the
subject property, provided such proceeding results in a£inding that
such Owner was in ~riolation of said Covenants and Restrictions,
Expenses of litigation shall include a reasonable attorney's fee
in~urrea by the Developer and/or khe ~i~sociation in seeking such
enforcement. -
