. Section 2. Notices: Any notices requirPd to be sent to any
member or Owner under the provisions of this Declaration shall be
deemed to have been properly sent when mailed, post paid, to the last
known address of the person who appears as a member or Owner on the
records of the Association at the time o~ sucta mailing.
Sect' 3. Severability: Invalidation of any one of these :
Covenants and estrictions by judgment or court order sha11 in no way
affect any ot er provisions which shall remain in full force and

, Section 4. Amendment: This Declaration may be amer~ded at any
tirne and from time to t me upon the execution and recordation of an
; instrument execute~ by Owners holaing not less than two-thirds (2/3)
~ of the vo~ing interests of the membersh.ip, provided that so long as
j the Developer is the owner of any Lot or ar~y property affected by this
s Declaration, or amendmenk her~to, or appoints a Director of the
Association, no ammendment will be effective without Developer's
express written joinder and consent. ~°he Developer may unilaterally
amend this document for purposes af compliance with regulations of any
governmental entity having jurisdiction, or may otherwise amend this
Declaration as it deems be~t, provided such other amendment.does not
adversely affect the interests of the then owners of Lots in Bay St,
Lucie Subdivision.
3ection 5. Usa9e: Whenever used the singular shall include the
plural an8 the singular, ar~d the use af any gender shall include all
genders.
Section 6. E£fective Date: This Declaration shall become
effective upon its recorc~ation in the public records of St. Lucie
County, Florida.
