EXNIBIT "D" LANDSCAPE REQUIREMENTS GOVERNING EXISTING TREES & VEGETATION AND WATERFRONT BANK STABILIZA'I'ION PLANTINGS: . I. PURPOSES The purposes of the~e requirements are to establish rules and requlations governing the protection of ~rees, waterfront stabilization plantings and vegeta~ive cover within the limits of Bay St. Lur.ie Subdivision and to encourage the proliferation and replacement of trees and vegetation ~rrithin Bay St. Lucie. This noble purpose is in recogni~ion of their importance and their meaningful contribution to a healthy, beau~iful and safer community attributable to their carbon dioxide absorption, oxygen production, dust filtration, wind and noise reduction, soil erosion prevention, surface ' drainage impravement, beautification and aesthetic enhancement of ~ improved and vacan~ lands, and the gensral promotion of the health, j safety, welfare and well being of the-community. ~ ~ ~ II. DEFINITIONS ~ (a) BUILDABLE-AREA shall be defined to mean that portion of a building site exclusive of the r~quired yard areas on which a structure or building improvements may be erected. • (b) DRIP LINE is a vertical line run through the outermost . ' portion of the crown of a tree and extending to the ground, provided however that the same shall be not less than a ten (10) foot diameter circle which is drawn from the center of the txunk of a tree. (c) REMOVAL shall be defined to include any inten~ional or negligent act which will cause a tree to decli.ne and die within a . period of three (3) years, including but not limited to such damage inflicted on the root system of a tree by ~he operation of heavy machinery; the chan~e of the natural grade above the root system of a tree or around the trunk of a tree; and the damages from injury or . from fire infZicted on trees~which results in or permits infections or pest infestations. (d) SHRUB shall mean a bushy, woody plant, usually with several permanent stems, and usually not over fifteen {15) feet high at its maturity. (e) TREE shall mean any self -supporting woody perennial plant which has a trunk diameter of two (2) inches or more when measured at - a point four and one-half (4 1/2) feet above ground level and which normally~ attains an overall heigh~ of at lea~t fifte~n {15) feet at maturity, usually with one main stem or trunk and many branche~.
