' (b) During the construc~ion s~a4e of development, the developer shall not allow the cleaning ~f.equipment or material within ~he dripline of any tree or groups of ~rees to be protected. Neither shall ~he developer allow the disposal of was~e materials such as . paint, oil.salvents, asphalt, concr~te, mortar and so o~? within the dripline of any trees or groups of trees. (c) No attachments or wire other than ~hose of a protective nature shall be attached to any tree. . {d) During the land clearing and construction stage of development a representative of the ARC shall periodically inspect the site to insure compliance with ~he provisions of ~his restrictian, ~ (e) Tree.location and rep2acement actively permitted ar required under this restxic~ion sha1Z lie done in accordance with ~tandard horticultural practices and procedures and all such plantings shall be reasonably maintainecl and attend to promote successful establishment thereof. X. EXCEPTIONS DUE TO EMERG~NCIES ~ - During the period of an emergency such as a hurricane, tropical storm, flood or any other Act of God, the requirements of these restrictions may be waived by the ARC. XI. ~XCEPTIONS EOR BETTERMENT PLANS Applicants for germission shall be entitled to demonstra~e by means of a propez la~dscape plan that an improvement for betterment of the environment can be accomplished over the existing site conditions, if such landscape plan is carried out to its fullest. If-such a detailed landscape plan is so offered and is accepted by the ARC, the applicant shall guarantee the faith~ul adherence and completion of such landscape'plan. - XII. EXCEPTIONS AS TO CERTAIN TREES The followinq trees or types of trees shall be exemp~ from the term~ and requirements of these restrictions: (a) Any diseased, infected or infesteci tree. (b) Schinus ~erebinthi€olius (Brazilian Pepper Tree). (c) Metopium toxiferum (Poison Wood). (d) Melaleuca Le~acandendron (Melaleuca or Punk Tree).
