PROPERTY FiELAT~D $ 33,270.49 _ Nov. 7 ~g $6 _ ~ I t s ; For value received, the undersigned (whether ono or more hereinafter called "Maker"), iointly and severally, promises to pay ~ to the order Sun Bank/Treasure Coast: National Association (which, together with (NAME O~ BANK) suLssquent holders of this note, are referred to as "Bank") at its oftice at Ft . Pierce Florida, ~ the principal sum oi Thirty--Three Thousand Two Hundred Seventv ~ 49/100 Dollars (5 33 ~ 270.49 ~ ~ wilh interest lrom the date hereot at the rate of _ 11.50 % per annum on tho tull amount oi said principal sum remaining trom time to time unpaid, payable in 120 monthly inslallments ot ~ 467 • 77 each on the ~~h day ~ of each successive month commencing on Dec . 7 , 19 86 . The Maker promises to pay late charges ~ not to exceed 5% of the amount of any payment or payments in default. All payments made horeunder shall be credited first lo interest and lawful charges then accrued and the remainer to principal. ~ Maker has the right to prepay 4his note, in whole or in part, without penalty at any time upon the payment oi accrued and past due ~ interest and charges to date of prepayment plus a sorvice tee in the amount of tha lesser ot S50.00 or 2 percent of the principal ~ amount of this lo~r (Amount Financed), provided, however, that any partial prepayment of principal shall be applied to the installment ~ or installments ot principal last maturing hereunder. ~ The amounts referred to above have been computed upon the assumption that aIl installment payments will be made on the ~ respective scheduled due dates. In!erest accrues on the unpaid outstanding principal balance. If any installment is not paid in (ull on ~ tha due date, Maker will be obligated to pay such additional amounts as may become payable by reason of the continuing accrual of f interost at the rate designatecl above. Any resulting charges accruing on account of failure to make timely payment on the due dates ~ will cause increases in some of the amounts designated above. Any installment payment made prior to any due date or dates, or any ~ prepayment, may cause decreases in some of the amounts designated above for ihe reason thai Ihe unpaid outstanding principal ~ balance will be reduced and ihe interest rate dssignated above is applied to such ~educed outstanding balance to determine the amount ~ ot interest that is d~le. ~ ~ If Bank deems itself insecure, or upon ihe happening of any of the following events, each of which shall constitute a detault ~ hereunder, all liabilities of each Maker to Bank shall thereupon or thereafter, at the option of Bank, without notice or demand, become ; due and payable: (a) lailure of any Obligor (which term shall mean and include each Maker, endorser, surety and guarantor of this ~ note) to p~rtorm any provision of any security agreament or mortgago securing the repayment hereot, to pay interest hereon when ~ due, or to pay any other liability whalsoever to Bank vrhen due; (b) the death of any Obtigor; (c) the filing o( any petition under the ; ' Bankruptcy Code, or any similar tederal or state statute by or against any Obligor; (d) an application for the appointment of a receiver ~ or the making of a general assignment for the benefit of creditors by, or the insolvency of, any Obligor, (e) the entry ot a judgment ~ against any Obtigar; (i) the issuing of any writ ot atiachment or writ of garnishment, or the filing of any lien, against any properry of s I any Obligor; (g) the taking ot possession of any substantial part of ihe property of any Obligor at the instance of any governmental ~ authority; (h) the dissolution, merger, consofidation or reorganization of any Obligor; or (i) the assignment by any Maker oi any equity ~ in the real property which is security (or this note, except as is permitted under the terms ot the mortgage, without the prior written g consent ot Bank. In addition to the mortgage securi+~g this loan, Maker hereby grants to Bank a security interest in all property of Maker now or at any time hereafter in the posse$sion of Bank in any capacity whatsosver, including but not limited to, any balance or share of any deposit, trust, or agent account, as securiry for the payment oi this nate, and a similar lien upon and security interest in all such property oi each Maker as security tor the payment ot a~l other liabilities of each Maker to Bank (including all Iiabilities oi each Maker). The Obligors, jointty and severally, promise and agree to pay all costs and exp~nses of collection and reasonable attorneys' fees, whether incurred in connection ~vith collection, trial, appeal or otherwi&e. Presentment, demand, protest, notice of dishonor, and extension ot time wilhout notice are hereby wai~~ed by each and every Obligor. Maker acknowledges receipt of a completed copy ot this note and mortgage on the above date. NOTICE TO COSIGNER: You are being aske~ to guarantee this debt. Think carefully before you do. If the borrower doesn't pay the debt, you will have to.
